1 Application of Terms of Contract

Plugin Smithy Software offers its services exclusively based on the following Terms and Conditions and exclusively towards entrepreneurs. In addition to this the licensing terms that are shipped with the products apply. Plugin Smithy Software objects the terms and conditions of the buyer hereby. Any divergences from the Plugin Smithy Software terms of contract are only effective if they are confirmed in writing by Plugin Smithy Software.

2 Exclusion of Exchange and Return

The software offered by Plugin Smithy Software is a non-material good. Because of its character it is principally excluded from exchange and return after shipment.Therefore Plugin Smithy Software offers its software as trial versions that are fully functional for a period of 30 days.

3 Licensing und Conclusion of Contract

The licensing of the software resp. the selling of software copies and rights to use the software is subject to the terms and conditions (notably licensing terms) that are published on the website. All quoted prices are net prices in EURO. The licensing terms can be downloaded and printed from the Plugin Smithy Software website at any time and before placing an order. The payment of a license is to be made as advance payment via PayPal, per money transfer or per check.

For the payment process via PayPal the terms and conditions of PayPal apply.

By sending the download information for the software by email after payment via PayPal, after receipt of payment with money transfer or after a check has been credited an order is accepted and the contract is concluded.

4 Delivery

The software and the documentation are delivered in digital format only. Licensee agrees to retrieve the software and documentation, as well as any relevant maintenance updates from Plugin Smithy Software's website at www.pluginsmithy.com. Neither digital storage media nor printed documentation will be delivered to licensee by Plugin Smithy Software. With the sending of the download information the software is deemed to be delivered.

5 Support

The licensee has no entitlement to support that exceeds the warranty that is determined by sales law. Support is provided by Plugin Smithy Software on a goodwill basis and exclusively by email.

6 Privacy Protection/Collection of Data

In compliance with § 28 of the German privacy protection law ("Bundesdatenschutzgesetz", BDSG) Plugin Smithy Software would like to point out that the in the context of licensing necessary data is processed and stored in a computer system according to § 33 of the German privacy protection law ("Bundesdatenschutzgesetz", BDSG). Plugin Smithy Software asserts that your individual-related data is treated confidentially. A transfer to third parties takes place only as far as Plugin Smithy Software is obliged by law or as far as a transfer is required in case of unlawful activities or breach of contract. All collected data is stored exclusively for internal purposes, in a safe environment that is not accessible to the public. With a purchase order you agree to the collection, processing and usage of your individual-related data in this respect.
